First is planned, premeditated. The officer is SO guilty, but he didn't leave home intending to kill somebody.

IMO it's absolutely 1st degree. Van Dyke told his partner on the way to the scene "we're going to have to shoot the guy." Within seconds of rolling up, he unloads 16 shots into a kid walking away. No other officers felt the need to use deadly force. This was 1st degree murder.
