Back in the 1970’s, when i lived in Philly, we did a study. We found young folks incarcerated for 20+ months, cuz they couldn’t make bail, waiting for trial, then having PD’s convince them to plead guilty - to get out w/ “time served”. They were innocent but now had a record.

Without cash bail the decision to be incarcerated pre-trail or free on personal recognizance will be solely at the judge’s discretion so be careful with what you wish for.

Canada led the way on this one
In 1982, the Canadian Charter of Rights and Freedoms enshrined the right to bail in the Canadian constitution. Section 11(e) of the Charter say "any person charged with an offence has the right not to be denied reasonable bail w/o just cause" - 1 more reply
