If you aren't interviewing developers at a whiteboard or at a workstation, how can you be confident they can write code?

+1. Code Sample as a requirement, a take-home test task after a successful interview.
I don't think it should be a requirement. There are plenty of reasons someone wouldn't be able to provide one.

It really should, if not open source than a couple of snippets of commercial code. If unable to share, retract to open source.
