Is the ES spec the arbiter of what legal TS should be? The fact that the spec describes what happens is not instructive as to whether or not you're writing a correct program. A doctor can describe what will happen to you if you eat a rock; that doesn't mean that rocks are food.
It depends on your definition of "correct program". There's multiple levels. Does it parse, does it execute without errors, and does it do what the developer expected. The last one is where TS comes in. Do you feel like the ES spec is restrictive?

People often make arguments like "the runtime technically coerces this to a string, it should accept 'any' instead of 'string'" which I am usually pretty skeptical of.
