This is a great example of my former law dean's admonition to "Never let your skill exceed your virtue." In this case, it's not that the argument is based on skill (it's dumb and wrong), but Dersh is capitalizing on his authority and reputation to sell out democracy. Disgusting. https://twitter.com/jaketapper/status/1222610638310121472 …

#Dershowitz’s either lost his mind or@realDonaldTrump has got video tapes. Dersh in effect is saying:#Trump can do anything, no matter how egregious, to aid is own re-election because of course he thinks that his re-election is good for the country!https://www.nytimes.com/live/2020/impeachment-trial-live-01-29 … -
Can we all just be honest? The GOP no longer believes in fair elections because fair elections gave us a black president. It’s really NOT more complicated than that. That’s the heart of Dersh’s argument that 45 can cheat if he thinks it’s in the national interest.

Dershowitz: I never said a president could do anything to get reelectedhttps://thehill.com/opinion/judiciary/480720-dershowitz-i-never-said-president-could-do-anything-to-get-reelected …

By Dersh's logic, Trump could expressly take out a "hit" on an opponent, but if he felt that it would assure him a victory it wouldn't be impeachable because he feels his re-election is in the public interest.
-
Can someone please ask Dersh if he concedes that, under his own theory of executive power, there is no basis to investigate Joe Biden even if all the allegations against him were true. https://twitter.com/AshaRangappa_/status/1222571231058239488 …
-
The thrust of Dersh’s argument is that campaign finance laws prohibiting foreign contributions to U.S. elections don’t apply to the President.
-
This claim that Congress can't possibly pass articles of impeachment on "abuse of power" against Trump, even after Congress passed articles of impeachment on "abuse of power" in both the Nixon and Clinton cases, might be Dersh's dumbest hill yet.
-
One more point about Dersh. The thought that 60yo Alan Dershowitz, already one of the most famous attorneys ever, would speak *without fully studying the issue* in 1998, but now, at 81, has *studying more* is just RIDICULOUS.

There's no joking or sugarcoating this. If the Senate votes this weekend to accept Dersh's if-the-president-does-it-it's-not-illegal line, blocks witnesses and gives Trump his quickie acquittal, we are a dictatorship. The rest is just filling in the details

Dersh says any danger Trump poses can be eliminated in eight months...after explaining why it’s totally legal and totally cool for Trump to do anything he wants to get himself elected in said election

Presidents cannot do anything illegal in order to get re-elected. But nor can their lawful behavior be turned into a criminal or impeachable offense just because it was motivated in part by electoral considerations. Lincoln, Obama examples. Please answer THAT!
-
IMPORTANT: The argument Dersh is making — that if the President thinks a candidate might be a national security threat he can investigate it — IS EXACTLY WHAT WAS THE BASIS FOR CROSSFIRE HURRICANE. If R’s accept Dersh’s logic, they better tell Barr to stop Durham’s “review”

Under the House Managers quid pro quo theory — to which I was responding — any president who took any action with the mixed motive to promote the national interest and ALSO to promote his re-election interests, would be impeachable. (MTC)

I challenge my critics – especially those who are deliberately misinterpreting my arguments – to a Lincoln/Douglas-type town hall debate in which name calling is prohibited and intellectual arguments must be responded to with other intellectual arguments. (MTC)

The American public would be informed better by a debate than by childish epithets such as those that are being hurled at me by partisan pundits, academics and politicians. Please respond if you accept.

Further distorting my argument, Senator Schumer and others are now saying that under my argument, Nixon was not impeachable. Of course he was. He committed numerous crimes: obstruction of justice; witness tampering; destruction of evidence; suborning perjury and more. (MTC)

What I said was that there are 3 broad categories of relevant motive: 1) pure national interest ( help the military) 2) pure corrupt motive ( get a kickback) And 3) mixed motive (help the national interest in a way that helps your reelection efforts ) (MTC)

I told Poppy on CNN yesterday morning that Trump’s mantra after this will be that he was never impeached. Looks like Dersh is setting the stage for this https://twitter.com/jenmercieca/status/1223602756575023106 …

Let’s elevate the quality of the dialogue and avoid ad hominems. The issues are too important to trivialize. The debate could be live or on TV. (MTC)
