Indeed. They're agreeing with him that their opinion left this issue open as a matter of fact to be tried - how could they not agree? - but presenting it as some sort of reversal because they used the facts developed at that trial to overturn the jury's factual finding.

Yes.* *In a compressed-for-Twitter form. It takes a while to explain the full procedural course. IMHO, the Fed Cir's footnote is an unusually catty rebuke to the trial judge given that even they agree (begrudgingly) he was right about this particular issue.
