It would have to right? If use enjoined, you could not file affidavit of use required under § 8 and the mark would die (eventually)

yeah and risk a libel suit? have to show use in commerce. libel case would wrap up quick with collateral estoppel and then mark is abandoned
it'd be stupid to do, for sure, but a cost to defamed person. A mere defamation prohibition wouldn't really harm any 1st amend rights, tho
