That's right you guys, I got my hands on the famous Fair Use Painting

I'm not an art person, but I'd put a print up in my office.

You're right. You are not an art person ;)

it's an aside in the article, but I love how much Alsup loves this jury.

it bugs me more than it should that the lines & line numbers aren't the same height/spacing

I can't believe that picture is what actually was presented; I thought it was some random "programming" stock picture.

functionality? Refresh my recollection?

API Library might’ve been dictated by functional/usability considerations. But Google didn’t raise it way back when
@sarahjeong -
isn't that congruent with copyrightability in this case?
-
Sure but 1) presumption of registration & 2) Google didn’t really attack validity this way but went w/ merger arg.
@sarahjeong -
when I get home, can you explain how a merger argument ended up as a fair use decision?
-
Well, in theory, it would go to 2nd and 3rd factors and hovers over the 1st.

@pmarca not at all silly and the screwdriver example only sounds reasonable because they seem obvious now. They weren't always. -
try designing a good or even mediocre API and tell us again how obvious they are
-
just because it's not obvious does mean it should get copyright protection; that is function, i.e. for patents.
@sarahjeong@pmarca -
strongly disagree. Much more akin to a work of literature than an invention
-
& patent law, such as it is, as applied in court, still makes far more sense for software than copyright law
@sarahjeong@pmarca -
disagree but don't care to argue so as you like
-
(in terms of enforcement and useful duration, they're both poorly suited to software)
