"We're the number one in innovation. Fair use protects innovation. To ridicule it is to ridicule innovation."

One of the jurors that got eliminated during selection mentioned that they didn't like what Oracle did with Peoplesoft!
-
I don't know what this appeal to Northern Californian innovation will do with these jurors.
-
I don't know whether they take pride in the tech industry.
-
Both Oracle and Google have staked their strong brands in this case. You can even see it in the damn powerpoint slides.
-
Oracle uses red design elements, Google uses blue.
-
Google really, really wants the jury to think Android is Good and that fair use is good because Android is good.
-
To be fair, this is a lot easier to sell than "SavaJe is Good"
-
But I don't know. I don't know how this jury—which draws from all over the Bay—feels about the tech industry.
-
We live in a time when tensions are running high about the effect of the tech industry on this area.
-
Anyways, I don't really know what that means for this case.
-
Van Nest's closer was a slam dunk for a Bay Area techie audience. IDK about a Bay Area nontechie audience.
-
Again, here's the jury instruction: https://www.scribd.com/doc/313560685/Jury-Instruction-Oracle-v-Google … We're about to start on page 16.
-
Still reading jury instruction to the jury. Foreperson not yet selected.https://twitter.com/tjwds/status/734826004800241664 …

If jurors decide it's not fair use, they're stuck here for another phase of the trial on damages.
-
Damages trial runs up until June 10th. Whew.
-
Jury is to deliberate from 7:45 to 1:00 pm every day.
-
I'll come to court until the decision comes in. You're welcome.
-
Jury can determine their own hours of deliberation every day so the hours might fluctuate. Last week they said they'd go to 1, though.
-
fwiw, if Google wins, Oracle is totally going to appeal.https://twitter.com/nilixblue/status/734828341941915648 …
-
And the jury is now out of the courtroom and into deliberations.
-
I highly doubt that verdict is coming in today (since we're almost at 1 pm) but never say never
-
We're currently discussing which experts can be used in the damages phase.
-
Someone coughed. A cough drop is being conveyed to them.
-
I am feeling an overwhelming desire to cough
-
Judge has left the courtroom. Both sides are cleaning up, no one's expecting verdict to come in but will linger until 1 I imagine.
-
No verdict today. See you guys tomorrow!
