"What are they, at the end of the day, when they're completed?"
-
-
"Fair use is not an excuse, ladies and gentlemen. The law endorses fair use in the name of innovation."
-
"The point is to encourage new ideas."
-
"We here living in Northern California know that the best. The air we breathe, the cars we drive, ... are because of innovation."
-
"We're the number one in innovation. Fair use protects innovation. To ridicule it is to ridicule innovation."
-
Now we are reading the rest of the jury instructions, and the audience is GTFOing because, you know.
-
Lots of empty seats now but I don't think CSOs are going to let people in here while instructions are being read.
-
It was very very good, but WHO KNOWS. https://twitter.com/BlueSpaceCanary/status/734820052881416192 …

Alsup reading the jury instructions out loud
-
So now I've gotten to hear a federal district court judge say a bunch of deserts in succession
-
Anyways, back to the whole "We live in Northern California!" appeal—
-
It's absolutely true that Google (AND Oracle!) have given a lot to this area. But they've also done a lot of less than appealing things.
-
Gentrification. Housing crisis. Google buses. Sailboat race cheating. The JavaOne shitshow every year.
-
Oracle might have its name on the stadium where the Warriors are currently owning the hell out of basketball.
-
But Oracle gets its name in the news in other, less positive ways.
-
One of the jurors that got eliminated during selection mentioned that they didn't like what Oracle did with Peoplesoft!
-
I don't know what this appeal to Northern Californian innovation will do with these jurors.
-
I don't know whether they take pride in the tech industry.
-
Both Oracle and Google have staked their strong brands in this case. You can even see it in the damn powerpoint slides.
-
Oracle uses red design elements, Google uses blue.
-
Google really, really wants the jury to think Android is Good and that fair use is good because Android is good.
-
To be fair, this is a lot easier to sell than "SavaJe is Good"
-
But I don't know. I don't know how this jury—which draws from all over the Bay—feels about the tech industry.
-
We live in a time when tensions are running high about the effect of the tech industry on this area.
-
Anyways, I don't really know what that means for this case.
-
Van Nest's closer was a slam dunk for a Bay Area techie audience. IDK about a Bay Area nontechie audience.
-
Again, here's the jury instruction: https://www.scribd.com/doc/313560685/Jury-Instruction-Oracle-v-Google … We're about to start on page 16.
-
Still reading jury instruction to the jury. Foreperson not yet selected.https://twitter.com/tjwds/status/734826004800241664 …
-
If jurors decide it's not fair use, they're stuck here for another phase of the trial on damages.
-
Damages trial runs up until June 10th. Whew.
-
Jury is to deliberate from 7:45 to 1:00 pm every day.
