good morning

-
That fucking filing cabinet is back in the courtroom again.
-
Alsup is seated. There's some disputes over exhibits in evidence. Alsup: .... Oh my god.
-
Alsup: This is not housekeeping. This is what is the trial record. So don't call it housekeeping.
-
There's a dispute over an exhibit because Google received it as a piece of paper, and Oracle admitted it as a giant poster.
-
Google: This is Exhibit 1028. *tiny paper* Alsup: So what's that then? Oracle: This is 1028.
-
Google doesn't have objections to the larger version going into the jury room as long as they get their own poster of the Android stack in.
-
Oracle is refusing to let Google's Android stack poster in.
-
Oracle says the Google poster is inappropriate because it's a demonstrative and makes an argument.
-
Alsup: Who marked the exhibit 1028, then?
-
I just want to say.... Google and Oracle are paying these people a whole lot of money to give a shit
-
I've been informed that Safra Catz and Kent Walker of the infamous bat mitzvah are in the courtroom.

The "my poster should be bigger" dispute is on hold for now.
-
Alsup is currently conferring with the clerk about an overflow room.
-
Clerk says that it's getting set up.
-
Alsup tells the gallery that we're not allowed to stand up or move during closing arguments.
-
Or jury instructions.
-
My back is already aching in anticipation.
-
Jury has entered the courtroom.
-
Alsup: This is not going to go by fast.
-
Alsup about to give the first third of the instructions.
-
We have begun jury instruction.
-
Siri just went off in the gallery.
-
Alsup did not hear.
-
Aside from myself, I have not seen a single person in this courtroom use an Android phone. It's all iPhones.
-
Jury instruction informs the jury that there was an earlier trial. Tells jury not to speculate on what happened in the trial.
-
"No determination on fair use was made one way or another in that trial," says Alsup.
-
Flashback: The jury hung on fair use in the first trial.
-
It wasn't an issue because Alsup ruled APIs weren't copyrightable anyways.
-
Then the Federal Circuit overruled him, and SCOTUS declined to accept the case. So here we are.
