God, I hate the "the All Writs Act is bad because it's old" line of argument. The Constitution is older but we're still okay with that.

@sarahjeong Yeah, but I don't think the age is the problem: again, it's the overbreadth of application compared w/ the purpose of the Act. -
@NSQE but the age isn't irrelevant to that calculus. not the primary factor to weigh, but not irrelevant. -
@sarahjeong True, but then the problem becomes the dearth of caselaw interpreting the AWA in modern contexts.

@sarahjeong@NSQE It's the flip side of the old "law can't keep up with technology" line. An old law can be interpreted--reasonably or not. -
