I'm also concerned that the best parts of Lenz will be viewed as 9th deviancy.
@djsziff I haven't gone back and reviewed the article itself but I am aware of the controversy and sympathetic to the argument

@djsziff honestly I find it hard to think of fair use as other than an affirmative defense but if an appellate ct says so I'm happy to agree -
@sarahjeong Prof. Loren presented the paper at UW, so I read an earlier draft. I'm a complete IP novice/idiot, but it seemed solid to me. -
@sarahjeong But of course as a novice/idiot, I'm obviously missing things, so I'm reading your analysis with much interest! -
@djsziff did you read my analysis that went up last night? IDK if I'll do further analysis specifically on Lenz (9th) -
@sarahjeong Yup! Also interested in defense vs. aff. defense stuff more generally, but that's really only bc I read Prof. Loren's piece. -
@djsziff I'll definitely be reading that paper soon! Just been a little busy since the decision came out :) -
@sarahjeong Of course! Didn't mean to sound like an assignment desk. Just wondering if you already had thoughts on the matter/article. Thx! -
@djsziff np. I think that academically speaking it's by far the most interesting thing in the decision.
