but the more I think about it, juries don't lack agency. Jurors are adults. If juries go along with prosecutors, they chose to.

Grand juries are supposed to be a check on prosecutorial power, juries are supposed to be a democratic check on the legal system.
-
And what if they're working as intended? What if our democracy is so racist it does not desire justice?

@sarahjeong You are assuming the prosecutor wanted them to indict. Most DA's see themselves as law enforcement = with cops. -
.
@SaltPotatoes I'm not, and I suggest you look at the context of my tweets. -
@sarahjeong Wasn't criticizing you. I suggest you chill. -
@SaltPotatoes I don't appreciate people dropping into my mentions to waste my time without seeing the context, misinterpreting my tweets. -
@SaltPotatoes And I don't appreciate condescending pronouncements either. -
@sarahjeong Obviously you do.

@sarahjeong Better to say that they're easily manipulated, in either direction. -
@waxpancake@sarahjeong not necessarily active manipulation; ppl have no frame of reference. How often does anyone serve on a grand jury? -
.
@SherwinPK@waxpancake I think both grand jurors & jurors bring with them a bias in favor of the police and prosecutors. That's on them. -
@sarahjeong@waxpancake I was thinking about the "ham sandwich" specifically. As in, grand jury does have a pro-indictment bias by design.. -
@SherwinPK@sarahjeong And what if the prosecution doesn't actually want the indictment? -
@SherwinPK@sarahjeong So it's not a pro-indictment bias—it's a pro-prosecution bias. We just expect prosecutors to seek indictment.

@sarahjeong That's one of those legal cliches, right? Like "slippery slope", "chilling effect" and "shout fire in a crowded theater"?Merci. Twitter en tiendra compte pour améliorer votre fil. SupprimerSupprimer

@sarahjeong I think that is accurate. Failure to return indictment therefore suggests intent of prosecutor -- clearly the case in FergusonMerci. Twitter en tiendra compte pour améliorer votre fil. SupprimerSupprimer

@sarahjeong Agreed. "When the defendant is a cop" is a major caveat to that one. If you and I faced this evidence, we'd be in jail.Merci. Twitter en tiendra compte pour améliorer votre fil. SupprimerSupprimer
