I have a question for the lawyers -- do you think Alito's concurrence means he wants to broaden search incident to arrest or to narrow it?

@sarahjeong On the other hand, it might expand searches incident to arrest if the cops can claim they had a rational basis for thinking that
@TheAlexKnapp yeah, I was thinking about how stop and frisk is supposed to be a "limited" exception and look how that's turned out

@TheAlexKnapp and part of that is "if police believe that a crime is afoot"-- that's not a narrowing factor if it's cops deciding that -
@sarahjeong Yeah, I think a likely case might be that it totally kills searches of cars incident to arrest but expands all the others. -
