@Pepyri_ so it’s being remanded back to the district court for a determination on fair use (it’ll probably get appealed again before that)

@Pepyri_ so you’d have to get the case on appeal into the Federal Circuit in order to take advantage of this ruling

@Pepyri_ and it may be the case that in a subsequent case, the 9th Cir will just ignore the Fed Cir and it’ll become a weird split-off case -
