Yes, the early common law on privacy focused on privacy as a property right. But the early common law was always about the gentry.

Today, we have enfranchised the propertyless, as well as those who were once themselves property.

Today, we understand privacy through the lens of the pro-choice movement —> the autonomy of a class of people who were once property!

Privacy is meaningful choice, privacy is a *conceptual* space to think and breathe and decide, not a real space that can be alienated for $.

@sarahjeong Interesting. I love me a property right, my tattoo is abt self-ownership. But to me privacy is not about property.

@CathyReisenwitz I think characterizing privacy as a property right is (1) a stretch; (2) problematic. It’s kind of the current law tho >:(
