Yes, the early common law on privacy focused on privacy as a property right. But the early common law was always about the gentry.
@CathyReisenwitz Yeah, someone said that surveillance state and communism are like the same because both take away property rights.

@sarahjeong Interesting. I love me a property right, my tattoo is abt self-ownership. But to me privacy is not about property. -
@CathyReisenwitz I think characterizing privacy as a property right is (1) a stretch; (2) problematic. It’s kind of the current law tho >:( -
@sarahjeong Agreed. Can we not justify it completely on civil liberties grounds? -
@CathyReisenwitz well, it’s tricky, right? Not mutually exclusive, 4th Am linked to trespass (e.g., infringing on a property right)… -
@CathyReisenwitz Like, I think that’s bogus and privacy needs to be understood on its own, but that’s where I *think* the law should go. -
@sarahjeong It is tricky, no doubt.

@sarahjeong@CathyReisenwitz The civil war took away slaveholding property rights from plantation owners. It was a good thing.Merci. Twitter en tiendra compte pour améliorer votre fil. SupprimerSupprimer
