Revenge Porn Is Bad. Criminalizing It Is Worse http://www.wired.com/opinion/2013/10/why-criminalizing-revenge-porn-is-a-bad-idea/ … Thoughtful piece by @sarahjeong How about notice-and-takedown?
@jerrybrito Depends on how it's structured and under what grounds. If it's a DMCA takedown, that's not an exception-- it's already the rule.

@sarahjeong Right, I mean a new exemption req modeled on DMCA. My concern is it won’t accomplish much except set a precedent for more reqs. -
@jerrybrito Worried about definition of revenge porn under such a regime--e.g., how explicit? What kind of intent? Whose intent? -
@sarahjeong Yup. I totally agree. I’m usually not a squish on anything. ;o) This one has me weirdly conflicted. -
@jerrybrito Well, I think a revenge porn takedown system, if narrowly tailored, might not be too bad. Going to mull over it. -
@sarahjeong You put your finger on it earlier, though. It’s the “narrowly tailored” that’s nearly impossible. And would it open floodgates? -
@jerrybrito VERY narrowly tailored would not do much for victims. But it might be better than nothing / wouldn't imprison people at least. -
@jerrybrito I'd rather push for anti-discrimination laws barring employers from firing over naked pics of employees. Hard to prove, yes... -
@jerrybrito ... but I think it could be a great step forward for a more sex-positive and equal society. - 2 réponses de plus

@jerrybrito Otherwise I think it might pose a problem for CDA 230. I worry about that. -
@sarahjeong Me too, but I’m sympathetic to the people who have their photos out there. Don’t know how to tell them why 230 is more important -
@jerrybrito Maybe start a public list of lawyers who are willing to go after exes and websites on a contingency fee?
