How would this help with behaviors that are currently not illegal and that basically nobody think should face *heavy* penalties, just *some* penalties (like unpopularity or lower pay)?

Like, a crappy roommate who leaves the house a mess. He clearly shouldn't do jail time. He just should have a hard time finding roommates. How could law be better than just refusing to room with him?
