Leeway/discretion in enforcement invariably creates an "aristocracy of pull." Old boys' clubs. Popularity contests. Corruption. *Some* discretion is unavoidable, since law is not code; but in real life, we have forces *optimizing* for *maximum* discretion.

The point is not "slavery reparations are practical to implement" -- they might not be! The point is -- why have we taken for granted that the only ways to deal with problems are ways optimized for increasing the role that pull/connections/elite whims play in our society?
