I mean, one can debate the merits of Toobin's specific explanation, but wouldn't we all agree that if you thought you **logged off** from an ongoing a video call, but hadn't, then your camera captured video of you in the privacy of your home, that would be an accident?
The problem is if you had some kind of blanket "rule" to protect this, some people would obviously try to take advantage. If you try to take it on a "case by case" basis then it's not really a "worker protection" since bosses will just fire people they don't like.
How would people take advantage of a "don't masturbate during business meetings" rule? I genuinely don't understand what the downside is.
