It's going to be a 5-4 court, regardless of what happens to Kavenaugh. If his vote fails tomorrow, they'll have a new nominee by the evening, and McConnell and Grassley with jam them through in December. Kavenaugh is a clear villain the left can rally against.

We all know it's going to be 2. So let's just start the "Impeach sex pest justices" movement now, they can aim for Kavanaugh and Thomas first, then work down through the federal circuit. Should create a ton of vacancies.

Lack of moral authority doesn't stop tragic decisions.

But it makes those decisions less legitimate—and the institution, too—in the eyes of the people.

The problem is that rulings that are seen as illegitimate are still enforced. We already have lots of them and don't need more. Better for the Left? Maybe but with horrible pain for real people in the short term.

But this is corroding the institution in a way that is understandable for centrists and brunch liberals. We, the left, know this already, but they’ve been confident in their institutions until 2016 hit. This opens their eyes.
