It’s time to start talking about this as it actually is: an alleged crime that can still be prosecuted in front of a Montgomery County jury https://interc.pt/2PPQ2PX  by @rmc031

cannot say for sure, but saw one lawyer say today that while rape has no statute of limitations, the incident, as described would fall under misdemeanor assault, in Maryland, and that does have a statute of limitation. I'm not an attorney, nor in Maryland, so I can't vouch.

"Both (first degree rape and first degree assault) are felonies with no statute of limitations in Maryland."https://www.washingtonpost.com/opinions/kavanaughs-accuser-deserves-a-fair-criminal-investigation/2018/09/19/c0605ec4-bc1a-11e8-97f6-0cbdd4d9270e_story.html?utm_term=.4e55e0e7064c …

Right. But the lawyer said the description in MD she gave would fall undet misdemeanor assault. I have no idea

I thought it said no statute of limitations for the felonies?

Yes but I guess he is saying it isn't felony assault. what she described, but 2nd or 3rd degree in MD, a misdemeanor

Would be up to a prosecutor to decide if it would fly with a jury

Yeah here are definitions in Maryland. For first degree you must prove serious physical injury. Otherwise it is second degree misdemeanor.https://criminaldefense.pricebenowitz.com/maryland/domestic-violence-lawyer …

You missed “attempted to cause.” She says he attempted to rape her, so first degree would apply.

Yeah I really don't think this can be litigated on twitter, it depends on what specifically she files a charge for, which is also what the MoCo police department said w/r/t statute of limitations
