Like, I've thought about this, and the ONLY reason to not do that is if you think Kavanaugh did it and the FBI will find out. But even THEN, you just go and nominate Amy Coney Barrett. Honestly, I don't get the GOP not taking the easy political road here. It's baffling.

If they operated by the book and honestly, yeah. But McConnell has no qualms about rushing through Barrett or someone in the time between elections and a Jan 2019 while everyone screams it's not precedent. Who knows, though.

But, to me that's why you DON'T do it. You campaign on Dems 'obstructing' it, but never pull the trigger until after the election, in the lame duck, when it has no electoral consequences, even if he has 3 percent approval.

Yes, they can--depending what you mean by worse. They can't confirm a proven liar for example. But if we can postpone until the midterms, and we win the Senate and/or House, it would be hard for a lame duck Congress to confirm a Justice.

It's so strange, over here in the UK it's so different. I couldn't tell you the names of any of our Supreme Court Judges, but from what I understand they don't quite have the same influence as those in the USA.

Ah well ours is a bit more complex in Scotland as our Supreme Court for criminal matters is the High Court of Justiciary and for civil matters, the Court of Session, save for referrals to UKSC on a devolution minute or human rights compatibility matter.
