This has been talked about before. Only the people at greatest risk would pay for it, and most probably couldn’t afford to pay enough to keep it fully funded. The wealthiest can self fund legal fees.

Maybe the registrars can make ACPA insurance an addon feature for each domain registered. I'd pay $0.50 extra per domain name. Helping out less solvent domain owners helps reduce the no. of bad decisions from being used as precedents against everyone.

Some might simply be unwilling to pay $5k (give or take) to defend a domain name that is worth less than that amount to them. Would the insurance cover a generic name worth a few hundred? Lots of considerations there.

Yes, the insurance would cover any domains with a viable defense. I've spent $60,000+ on my ACPA action re http://sesamesnaps.com etc domains. I am suing for RDNH damages on 5 similar domains after losing a UDRP to a Polish company that committed trademark fraud in Canada.

You would theoretically need 120,000 domain names in that program paying $.50/each just to cover that bill. Now imagine if there are 10 a year. That’s a lot of domain names, and I don’t think investors would be willing to pay $.50/name.

I think it is a good idea, but I do not think it would be feasible or sustainable. Domain investors tend to be cheap. I suspect most of the higher tier investors have an attorney on retainer or would prefer to choose and fund their own defense and strategy.

This is one of the cases where the #UDRP panel got it wrong, and where someone was apparently outgunned on a legal turf. It is tough to justify executing a $20K legal defense for a domain worth less than that. This is why UDRP is so important. Shame on @WIPO. Seeds their demise.
