I'd say they're aspiring to "humility" (whether they're successfully humble depends on how well they guard against errors). Successful "modest" performance is when you act lower-status than the status people think you're entitled to, in a way that actually raises your status.

In other words, the key threshold for "modesty" is not the average person's status, but much status the average person thinks you have. A billionaire who acts like a millionaire will be called modest; a slave who acts like a peasant will be whipped for arrogance.

Interesting question. "Is" a person? I don't think there's enough information. "Can" a person? Of course. I think of professional athletes. They are right to assume they are more skilled at their sport than most anyone they meet. They can still be modest regarding their peers.

I tend to think modesty is more in public presentation. If someone correctly believes they are in the 90th percentile and they speak of it often and with pride, they are not modest. Modesty would require subtle downplaying. “There a lot of people that are better than me.”

It depends on what you mean by 'better.' You can think you are in better shape, more knowledgable, than most people, but still not better than them morally.

I'd probably define modesty as the mirror opposite to self-satisfaction or complacency. If you're always irritated by flaws in your work no matter how well it seems to come out, you're probably being modest no matter where you (believe to) actually stand in comparison to others.
