What do folks think about the potential legal and state bar jeopardy that Keith Davidson could be facing in representing these three women in Cohen-negotiated settlements? I’m thinking the principle reason why his license is in trouble is because he didn’t seem to be truly representing the interests of his clients. Cal. RPC 3-300 and 3-320 both could be at issue, depending on the facts.

Don't know. There's a story (linked) that suggests that Davidson has a lengthy history both as an ethical cesspool and as a lawyer involved in these sort of arrangements, so might not be collusive. But there are definitely a wealth of possible issues. http://thesmokinggun.com/documents/investigation/keith-davidson-profile-907453 …

If it's a coincidence, its remarkable. The other remarkable thing is how little money was paid. As a lawyer, I would be embarrassed by the settlement amounts given the potential damage these women could have caused. Any two-bit night school hack could have recovered more.

Davidson apparently led Stormy, at least, to believe she was bound by a non enforceable contract. But he never got the other party-djt-to sign it. This harmed his client, as she relied upon the belief she could not speak and she didnt get the benefit of the bargain she agreed to

If by virtue of a relationship with Cohen Davidson negotiated three settlements for three clients for $130,000, $160,000 and $1.6M, how have the clients been harmed? This is of course a different question from whether the outcome is bad for the general public.

If he intentionally negotiated the settlements at a value less than expected. If he received money directly from other side to do so or received referrals based on reduced settlements.

Hard to assess whether “less than expected” by the client is the standard, and, if so, how to determine that since client expectations can surpass what the facts warrant. Consider whether the clients are victims of Davidson or whether public interest harmed by secret settlements.

I feel like failing to vigorously pursue client’s interest is a heavier lift than conflict of interest.

It sounds like he and Cohen had some sort of quid pro quo arranged for these cases. That’s the kind of personal conflict of interest that will get him disbarred if not jailed.

Not to defend Davidson, but what is the clients' complaint about his services under the California RPC or standard negligence/fiduciary duty standard?

Most “deals” that silence women have to do with lunchroom/boardroom slander and gossip, and decisions between rich men and their enablers (think:Black Cube) to destroy the lives, livelihoods, and spirits of all women who dare to condemn the status quo.

I don't know which state licensed him (he resigned from NJ bar, interestingly), but I think the California bar would find a violation.
