Wow, Erwin Chemerinsky tried to get J Reinhardt at age 84 to take senior status so Obama could name a replacement on the 9th Circuit. Note in 2014 he said J Ginsburg and maybe Breyer should retire for the same reason. Erwin's classless and distasteful "I told you so" is also wrong. Although the Judge is no longer alive to rebut Erwin, he had his reasons and on the politics of the Ninth Circuit, he was always right. Erwin should stop it and show some respect.

Per usual, Erwin was almost certainly right in both instances. It’s so difficult to balance the conviction that no one will be as good for one’s causes as is one’s self & the risk of actually setting back the causes because of that predicate belief.
