Scalia's description of himself as a "faint-hearted originalist" is never more obvious than Heller, where he rejects the explicitly-stated original intent and statement of purpose in the very text of 2A.

Only if you have been huffing glue. Heller enumerated a right that was first codified in the Magna Carta in 1400 or so, i.e., the right of a male citizen to carry a weapon of war in public, a right that was a part of our common law that came over on the Mayflower.

Magna Carta in 1400? You must have been dozing when you were listening to that podcast. Any common law rights are protected by the 9th, not the 2nd, which was clearly intended to prevent Congress from disarming state militias, which are solely National Guard units these days.

Originalism is chosen for the outcome and ditched when inconvenient. Particularly Scalia, but most others as well.

The only thing that can defeat half the text in an amendment as written is textualism; the only thing that can defeat textualist originalism is history and tradition...unless it’s the history and tradition in Stevens’ dissent...and next time: incorporation for federalists!
