I was one who suggested that as a caveat. And, I think you are a bit off the mark acting like they treat the two the same. They do not.
As I said, the Court treats them both expeditiously compared to many other cases. Didn’t say it treats them exactly the same. See for example Justice Ginsburg’s 5 am dissent in a Texas voter if emergency stay request.
I mean there also is the case in federal district court by a different group of Republicans asking for the same relief. Argument in that case last Friday and court said it would rule soon. Doesn’t seem unreasonable for SCOTUS to give a period to see what happens there.
Of course, they are SCOTUS and can do whatever they want. But if they are skeptical and inclined to deny but also don’t want to completely preempt lower court with a denial, why not wait at least until regular conference?
