I mean, I never said they're unable to act. They obviously are. And, I think this tweet sorta misses the point of why they have to act on death penalty applications.

I was responding to folks suggesting that maybe they’ll wait for their conference to decide or regular orders to issue a stay. But the Court’s practice is usually to act expeditiously in both death cases and election cases with deadlines

I was one who suggested that as a caveat. And, I think you are a bit off the mark acting like they treat the two the same. They do not.

As I said, the Court treats them both expeditiously compared to many other cases. Didn’t say it treats them exactly the same. See for example Justice Ginsburg’s 5 am dissent in a Texas voter if emergency stay request.

Seems to say that they aren't concerned about the new map going forward, or they would have acted before this to stop it. A week is a bit much, when they said they were going to act as quickly as possible.
