The lower court cases interpreting Heller to allow for lots of gun regulation led to a strong dissent from Justice a Thomas last week, complaining that the Court is treating the Second Amendment as a second class right.

Indeed, in the last few years liberals have come to appreciate the living constitutionalism and balancing of Justice Scalia in Heller (despite its couching as originalism).
