        I agree with this one more than the last one. ;-) As I tweeted to you, that characterization of King was quite unfortunate and inaccurate. There are good arguments for the majority's view that don't require misrepresenting the case for the other side.

        I think the important question is not “was he critical of Scalia” in this article - as it would’ve clearly nullified his argument to not be - but instead to ask: did he write this criticism of Scalia during that worship, while he was alive?

        You make a good, reasoned argument. But what you suggest would be only more unilateral disarmament by one side, and only add to the asymmetry. Would that help or hurt? The answer is unclear.

        Makes sense to me. Except for the claim that Scalia "revived the role of justice as public intellectual". The public displays I caught were attitude over intellect. Case in point, his opinion in Scalia v. Stahl (on "60 Minutes"): "because I'm right and your wrong".
