I agree with this one more than the last one. ;-) As I tweeted to you, that characterization of King was quite unfortunate and inaccurate. There are good arguments for the majority's view that don't require misrepresenting the case for the other side.

I responded saying there’s greater development of idea in boos—-though I suspect you will still disagree

I look forward to reading that. We may well disagree on the analysis. My response is to a particular factual claim ("single clause in single sentence").

Did this hold for Scalia too?
-
I think his article is quite clear in its criticism of Scalia for similar conduct.
-
I think the important question is not “was he critical of Scalia” in this article - as it would’ve clearly nullified his argument to not be - but instead to ask: did he write this criticism of Scalia during that worship, while he was alive?

I agree with you. Political celebrity is rooted in the perception of ideological purity, nothing more.

You make a good, reasoned argument. But what you suggest would be only more unilateral disarmament by one side, and only add to the asymmetry. Would that help or hurt? The answer is unclear.

Makes sense to me. Except for the claim that Scalia "revived the role of justice as public intellectual". The public displays I caught were attitude over intellect. Case in point, his opinion in Scalia v. Stahl (on "60 Minutes"): "because I'm right and your wrong".
-
Which is what his dissents usually seemed to reduce down to, once you got past his own argle-bargle.
