Divided North Carolina Supreme Court holds Republican legislature attempt to stop New Democratic governor from appointing majority of members of state /county elections board violates state constitution separation of powers.https://twitter.com/john_rimes/status/957003512826810369 …

This makes the separation of powers reference to John Orth’s work (which Justice Newby co-authored) quite amusing. I actually took Justice Newby’s State Constitutional Law class while he was working on this with John Orth, one of the best classes I ever took.pic.twitter.com/BRlXHuUq0Y

Was Newby one of the dissenters?
-
He was, and even wrote his own dissent separate from Martin’s on basis that the matter is a nonjusticiable political question. See pp. 52-74, considerably longer than Chief Justice Martin’s dissent, too. https://appellate.nccourts.org/opinions/?c=1&pdf=36529 …
-
How did they reason that questions over whether acts of the legislature violated separation of powers was a political question? In some sense literally everything the legislature does is a political question.

Dissents from Newby, Jackson and Chief Justice Martin, all Republicans.
-
Again...I don't even know which side is correct, but more proof that judges just vote with their party.
-
If course they do Gorsuch doesn’t even try to hide his republican affiliation.
-
No one does.

So Justice is not blind, and never has been. The facade is wearing through. Darn Internet!
