Notable that Kozinski offers an "only joking" type defense. Cue the @5thCircAppeals thread....https://twitter.com/rickhasen/status/942778157614039040 …

The other thing notable about the Kozinski statement is that it is directed only to his clerks, male and female, misunderstanding his humor. No response to allegations of conduct and touching related to non-clerks. And with the retirement there likely will be no investigation

I assume the judicial conduct investigation that the Chief Justice transferred to the second circuit will now be mooted.

I've not seen anything from the @VolokhC on this. Have I missed something? Here's the closest I've found to a defense of Kozinski.https://blog.simplejustice.us/2017/12/18/kozinski-resigns-and-the-fools-rejoice/#more-35618 …

This @mauradolan piece says 2 of Kozinski's clerks (not 3) had quit, and that after the first accusations "he sounded more rattled" than appeared on the quote that he was "not worried"http://www.latimes.com/politics/la-pol-ca-judge-alex-kozinski-20171218-story.html …

But this @mauradolan LA Times piece also said that Kozinski "apologized for having offended people" but this is incorrect. He only apologized for offending his clerks and said nothing about inappropriate touching.

As far as I know judicial disciplinary proceedings have invariably been dismissed with no further proceedings upon judge's retirement. My understanding is that the only post-retirement actions in Martin's case were identifying him and referring matter to DOJ, not investigation.

From my perspective is that he needed to go. He sat on the immigration issues, santuary city cases, block suits re his colleagues. That is the bigger picture. #draintheswamp.and revamp the judiciary with fresh, young eyes.
