One threshold issue that I don't understand -- how would this ploy create a "new vacancy"? It's the same old vacancy, no? What am I missing?

Yeah, I get it for the 17A issue, but that aside, I don't see why anyone would think that as a matter of state law (or logic) this would somehow enable the governor to cancel the election.

you'll have to take that up with @hughhewitt, who advanced this argument on Twitter Saturday in a discussion with me.

I think Eric's point, which I agree with, is -- are there any actual lawyers who think this is legit? I try to understand the arguments but I'm not seeing anything at all that passes the laugh test here.

One other question: can GOP afford to lose Strange for tax votes? If he resigns?

by their logic they can just reappoint him to the temporary seat after he resigns!

or just keep on structuring resignations and new appointments before each election, for years, and never lose the seat?

This mechanism would also allow a governor to dodge the elections in perpetuity if he finds a temp senator willing to step down and be reappointed every few months. There's no way it's legal under 17
