So the lower court ruled & SCOTUS affirmed summarily – and we should consider as authority what the lower court wrote about maybe ruling the other way if the facts had been different?

Seems in both cases, after extended discussions, the federal courts didn't tell the states how to proceed. As for Hewitt's idea (no special election, just wait til 2020) I can see the problem there; but eg if Gov (now) set the date on Nov 6, 2018? \_(?)_/
