    I don't think the desire to cancel the election is to stop the Democrat from winning - it's to stop Moore from winning. Regardless, I agree with you. If Moore does get elected, he should be immediately ejected from the Senate after he's seated.

        My evidence to the contrary is my conversations with fellow GOPers over the last few days. Moore in the Senate is a lose/lose proposition for the GOP. If he wins, we lose. It's much better for us if he doesn't get elected, frankly.

        Powell v McCormack - they cannot prevent Moore from taking office but they can (probably) expel him via 2/3rds vote after he is seated.

        There is no limit to the expulsion power as enumerated in the Constitution. Preventing a member from taking office (the situation in Powell) is not explicitly outlined in Article I, and so the Court ordered Powell seated.

        @chucktodd reported earlier that McConnell viewed a Moore win as worse for republicans than a democratic win. It was unclear to me if he was speculating or if he was conveying something a source close to McConnell had told him.

        Wait, is Hugh arguing Strange should serve until... 2018? 2020? I thought at 1st it was postpone special until early ‘18 so GOP can pick new candidate, which I don’t support but doesn’t strike me as horrifically anti-democratic.

        I'd have to look at the case law, but the Constitution doesn't explicitly limit the power of expulsion.
