It makes me think of Madison in Federalist 10 saying no one can be a judge in his own case.

Nixons OLC said no, but they came up with a cockamamie plan he could refuse under 25th amendment and the VP could.

Seems more likely a self-pardon holds up more readily than a fraudulent delegation of presidential power.

For the others, though: Can't take the 5th if pardoned; subject to contempt/perjury for post-pardon actions. Correct?

I'd bet $5 SCOTUS would find that to be a political question (meaning they wouldn't stop a president from pardoning himself).

OLC has opined that Prez can't pardon himself--but he can invoke 25th Amend and let VP pardon him while not Prez. https://www.justice.gov/file/20856/download …

If a president could pardon himself couldn't they ignore all court rulings and just continually pardon himself?

There is no Platonic answer. We can't know until (at least) five SC judstices say whether the president can pardon himself.

If Trump pardons his friends and family, wouldn't they be barred from taking the Fifth? Could he pardon them for their subsequent perjury?
