Frankly, if it were me, I'd find that political gerrymandering is also unconstitutional as a violation of fundamental voting rights.

Because he wasn't on SCOTUS when it was argued. So he doesn't get to vote on it.

I know why. In the VA case Thomas rejected the idea that complying with Section 5 of the VRA was a compelling interest anymore.
