If AG/Gov w/drew & BOE takes no position is there any party petitioner at this stage?
-
-
-
the question is who represents and can speak for the state of North Carolina. Legislature says it
-
But Legislature has yet 2 move to intervene. Until that happens, seems there's no party petitioner B4 the Court, right?
-
the state of NC is a petitioner. And Leg says AG must represent Leg's interest for the state
-
Can legislature intervene thru outside counsel if AG refuses?
-
not clear
-
thanks for the clarifications, Rick

Depends how badly R, K, T & A want to whack the 4th Cir. decision. If yes, they'll let Leg intervene. But echoes of Obergefell.

Correction--Perry (Cal case where state did not seek SCOTUS review after 9th Cir affirmed dist ct).
