If #Halbig was obvious case for en banc rehearing, it wouldn't take two weeks to consider briefs

@rickhasen When I clerked on D.C. Circuit, we were busy in August preparing for cases and reviewing en banc.Thanks. Twitter will use this to make your timeline better. UndoUndo

@rickhasen My only point is that if it were a slam dunk -- like AMI -- it would be quick. -
.
@jadler1969 I understand your point but (1) August/Labor Day and (2) 2-3 weeks is still pretty quick in Court of Appeal time. -
@rickhasen@jadler1969 2-3 weeks is *speed of light* for the usual legal process. -
@EricKleefeld@rickhasen Again, AMI went en banc this year w/in 1 week of opinion & this case expedited from day 1 -
.
@jadler1969@EricKleefeld If we don't have something by the end of this week, I'd accept it as evidence of "no slam dunk" for en banc -
@rickhasen@EricKleefeld And by end of week, I'll have#s on time btwn briefs and grants for all en bancs in past decade.
