@rickhasen McDaniel's plan isn't that bizarre; it worked for Bill Baxley in Alabama Dem run-off for Governor in 1986 http://www.nytimes.com/1986/08/02/us/alabama-democrats-runoff-for-governor-is-thrown-out.html?module=Search&mabReward=relbias%3Aw%2C%5B%22RI%3A11%22%2C%22RI%3A14%22%5D …

.
@JoeLenski McDaniel could have chance of winning court challenge in#MSSEN only if he cd show 6000+ votes by Ds voting in earlier primary -
@rickhasen agree it will be tough, but it is not unprecedented for run-off results to be thrown out due to large number of cross-over voters -
.
@JoeLenski My guess is McDaniel camp having trouble showing many cross-over voters who voted before--hence other theories like vote buying -
@rickhasen It would be interesting to go back to the 1986 case and see if Baxley actually proved there were enough crossover voters then. -
@JoeLenski@rickhasen Fascinating, but sounds like Baxley won by proving illegal change to voting procedures under Section 5! -
@DKElections@rickhasen I'm surprised we haven't yet seen McDaniel camp use 1986 AL precedent; gotta be material there for lawyers to use -
@JoeLenski@rickhasen Found the decision http://www.leagle.com/decision/19861833641FSupp1192_11678.xml/HENDERSON%20v.%20GRADDICK … Doesn't seem too helpful for McD on its face - 1 more reply
