@espinsegall The challengers' focus on political process cost them Breyer's vote. -
@espinsegall Not that it would've mattered w/o Kennedy, but Breyer's concurrence distinguishing Hunter & Seattle was pretty devastating. -
I have never been a fan of the political process cases. They have have a place but they are not easily defended. RT
