In Bush v. Gore, the Court divided 5-4 over whether to remand case to FL Sup. Ct for recount meeting equal protection standards. Majority said no new recount because FL wanted to take advantage of benefit of safe harbor and time was up. 2/2

Last time I checked "the second week of December" was a date certain amongst many others. This is like when they add "legislators" to the State's shall choose the manner of the selection of their electors, you know the State's are more than just the legislative bodies.

Why hasn't SCOTUS refused to hear Texas yet? I expect them to prior to Safe Harbor Deadline tonight. They taking a lunch?

They have to decide to hear it which every legal mind I’ve read today says they won’t. Texas apparently has no standing to bring the suit...which is of course why Ted Cruz volunteered to go to court with it. Because he knows he won’t have to.
