There's an excellent chance that tomorrow the Supreme Court will announce it will take up (again) the question whether partisan gerrymandering is unconstitutional. Don't take an agreement to hear case as a sign the Court will police gerrymandering. It is actually the opposite. /1

Rick, if this Court got into the policing of partisan redistricting, it would do so in ways that would benefit the GOP. I’ve always argued the Court should stay out of this (for politically neutral deference reasons) but now surely better they leave it alone, all of it.
-
Personally, I'm far, far more concerned SCOTUS will overturn Arizona Independent Redistricting Commission, which will cause far, far more damage to gerrymandering reform than holding partisan gerrymandering is not justiciable.

Agree 100%.

Oh fun. Then again, hard to tell how an UnJustice will act after a keg party.

The conservative majority is as illegitimate as Trump is.

Court opinions say part of the difficulty is defining where the line is between legality and illegality. "I know it when I see it" isn't a terribly objective measure. But new mathematical techniques have been developed for evaluating proposed district boundaries as fair or not.

I would share your cynicism if not for the likelihood that it will be Democrats who will be positioned to do most of the gerrymandering for the next ten years, thereby potentially triggering a sudden outbreak of concern over the issue.

Politically speaking, the best way for Kavanaugh to improve his reputation and avoid extended scrutiny would be to let the appeals court ruling in the NC case stand. That would turn down the temp. It's not a strong case from a GOP perspective.

There will be no Supreme Court ruling which empowers rank and file Americans as long as five Federalist Society members sit on the court.

The scotus is a blatantly partisan, illegitimate entity. Bought and paid for by the secretive Federalist Society. Originalism is a scam posing as an ideology in order to provide cover for conservative activist judges.

On what grounds did the lower courts rule partisan gerrymandering to be unconstitutional? It's been going on since the country was founded. Are there precedents?

They’ll say, I assume, that it’s the Constitution that makes such “reforms” difficult. And so it goes ...

Gerrymandering works both ways. Demographics are on the Democrats side long term, bigly. They’d better be careful.
