18-year term limits for Supreme Court Justices is an idea that unites right, left, and many in between. I think there may be a window to get this done when there is a period of a president of one party, a Senate of another, and a dwindling Supreme Court membership.https://twitter.com/lsolum/status/1049756408726675456 …

It seems like a sensible idea to me. There is a serious argument that it is unconstitutional, but that depends on the meaning of the "good behavior clause." The political problem is that it will always be seen as benefitting one party or the other.

If the Democrats manage to take the Senate this year and Trump gets a vacancy in 2019, I could see a "gang" of centrist Democrats trying to push it *if* they can be persuaded to support the idea on the merits. That strikes me as an unlikely but not utterly fantastic scenario.

When the constitution was devised, the average lifespan was 35 years. A lifetime appt was less than 10 years. With people reaching octogenarian and even centenarian status, decline in physical and metal capacity is a real issue. Term limits make sense in this millennia.

And that wasn’t true even ten years ago. But it seems to be true now as I always discuss this wherever I go, and the popular media has caught on too.

But requires amending Constitution, yes? Which seems like it might be tough.

Not necessarily. They have a federal judge job for life but not necessarily a SCOTUS job for life, as long as their salaries aren’t reduced.....

It doesn’t solve your constitutional issue, but 18-year terms, vacancies in pairs, absurd Senate confirmation number (75?) to force negotiation.

I think 2/3 would be reasonable and future proof it in case PR or DC become states

Liberals love the idea of term limits when the court appears to be headed to the right and conservatives love the idea when the court appears headed to the left.

I'd like it to include some sort of mechanism for inducing compromise during times of divided gov't. I don't really believe that "lowering the stakes" will do anything for that. Anyone have any suggestions?

Why 18 instead of 20? I assume you're keying it to the Senate instead of Presidential terms, but why? Also, how do you ensure staggering? If you made it prospective-only that would work, but wouldn't free up spots at any faster rate.

Why would the GOP agree to dismantle their victory to satisfy a mythical "moderate" base? Who do you think they are, the Democrats?
