        I don’t think the letter and it’s vague apology does much to assuage the legal community. And apologizing to John Roberts is best done privately on the court. The Op-Ed is about the Senate.

        Given what he has already done to destroy any semblance of legitimacy, it seems that the hypothesis of not yet having the votes in the Senate is the more likely rationale for writing the op-ed.

        I don't understand this logic. Does the DC Cir. not count as a court with the same standards for judges as the Supreme Court?

        Technically, SCOTUS isn’t bound by the judicial conduct rules that govern the lower federal courts (essentially on separation of powers grounds) but albeit via norms, rather than rules, the institutional traditions are essentially are the same.
