Important piece by Greg. I think main reason Rs don't want to bring in FBI (aside from what it might find) is the clock. Investigations take time, meaning if cloud continues to hang over Kavanaugh they'd have to try to confirm replacement in lame duck, when Rs may not have majorityhttps://twitter.com/ThePlumLineGS/status/1044214188057473026 …

Also in this piece, I try to address the question of what the proper standard should be for Kavanaugh, pivoting off the work of @benjaminwittes and @qjurecic. It is a tough question. But those who oppose bringing in FBI need to defend their low standard: https://www.washingtonpost.com/blogs/plum-line/wp/2018/09/24/another-female-accuser-just-stepped-forward-so-why-wont-republicans-call-in-the-fbi/?utm_term=.4a8b82194d23 …

??? They will still have the majority during the lame stuck, by definition.

What he means is that confirmation in the lame duck would cast an even greater cloud of illegitimacy over the process. I hope this isn't your only takeaway from this piece and his response :)

Ironically, failing to pull the nomination or treat these allegations seriously may be the thing that costs them the majority.

R's will have majority in lame duck. It will take a lot of nerve to do it, but it would be no surprise. In fact, the loss would only galvanize their need to do it during the lame duck.

The FBI investigation for the Hill/Thomas hearings took two days. Even though we likely need more than two days, there's no reason to assume it will be excessive. This is a lifetime appointment to the highest court in the land. Maybe we can wait a week.

if you don't seat a justice by start of term, how does that impact decisions for the term? Would the new justice have to sit out the whole term effectively?

It's funny how all these questions were unimportant when GOP refused to even hold hearings for Merrick Garland, whose only crime was being nominated by a Democratic President.

8 justices is less than ideal, but the Supreme Court will be a lot less functional if one of their 9 is a guy who's got at least 3 or 4 uninvestigated sexual assault allegations hanging over his head.

i don't disagree! I'm not arguing that Kavanaugh should be seated-- he shouldn't be. I'm just wondering what the stakes are for the Oct. 1st deadline.

The clock is arbitrary. If I were Kavanaugh I would want to get the FBI involved to CLEAR my name if I am not guilty. Trump should want the FBI involved & should prosecute anyone who lies to the FBI.

The only clock ticking is in republican leadership heads. We do not have an actual clock. This renders the argument of time moot. The FBI took three days with Anita Hill. It can do its job with Dr. Ford and the other accusers in a short period.

GOP could prob jam someone through by Dec., if they make change now. The (admittedly speculative and) conspiratorial part of me wonders if they're concerned about something that might be on Court's docket before a Dec. confirmation. A post-election bombshell from Mueller, maybe?

No. There’s almost 2 months until the midterms. They could have an investigation and still confirm him before the election. They’re afraid of more scandals coming out. AND that the investigation will show him to be unfit. We know it will because we already know he’s unfit.
